WINTER STORAGE AGREEMENT

    THE MARINA does not accept any responsibility for damage and loss sustained by the owner of any boat while docked or stored on its premise.

     The Owner authorizes THE MARINA in case if in case if any emergency caused by flood, storm of any kind, fire, etc., to take any and all precautions to prevent any loss or damage to the boat while stored or docked on its premises and to pay any expense or charge incurred.

     The Owner agrees to be subject to a fee of $150.00 per month for each month or part of month during which the said boat remains stored on the premises of the MARINA after May 1, 2011.

     The Owner agrees to assume all responsibility for the conduct of any guests while the boat is stored on the premises of the MARINA.

     For and in consideration of the price set forth above and in consideration of THE MARINA signing the Agreement, and the Owner, having made a thorough inspection of the MARINA and facilities therein, hereby agrees that he will assume all the risks of injury, loss or damage attendant to any regular activity or event in and around the MARINA; that the MARINA, its agents or employees shall not be liable for any personal injuries sustained by the Owner or any persons invited on the premises by said Owner, however such injuries may sustained, and whether or not due to the negligence of the MARINA or any of its agents or employees:  that the MARINA shall in no way be liable for any damage, loss, theft, destruction or deterioration of or to the said boat or any property attached thereto or left thereon or in the contents thereof: and the Owner agrees to indemnify and save harmless the MARINA for any such damage, loss, damage, expense or judgment incurred by reason of  any such damage, loss, theft, destruction or deterioration as aforesaid or by reason of any such personal injuries sustained by the Owner or his guests.

     The waiver by the MARINA of any conditions shall not be construed as a waiver of any subsequent breach conditions or default of any terms of this Agreement.

     Owner agrees not to display “FOR SALE” or other signs on his boat and gives the MARINA the right to board and remove any such signs if displayed.

     Absolutely NO outside contractors allowed in yard without permission of THE MARINA.  Owners are allowed to work on their boats, providing they cause no danger to their boat or others.  The MARINA reserves the right to stop the Owner or workmen if the MARINA feels they are causing danger to others or property.  Winter covers will consist of shrink-wrap or canvas.  The MARINA reserves the right to remove unsightly or ripped covers. No Bottom antifouling or sanding until agreement with MARINA.

     No discharge of oil, antifreeze, gas or pressure washing on MARINA grounds.

    All boats MUST PROVIDE A  CERTIFICATE OF INSURANCE.
